370 said Samuel D. Lynch his executors administrators and assigns to his and their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said Joshua Gray do and shall well and truly pay or cause to be paid unto the said Samuel D. Lynch his executors administrators or assigns the full sum of one hundred and fifty dollars current money with legal interest for the same on or before the tenth day of October in the year 1854 then and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes anything herein contained to the contrary notwithstanding and the said Joshua Gray doth hereby covenant promise and agree to and with said Samuel D Lynch that he will pay him the said sum of one hundred and fifty dollars with interest from the 10th day of October 1849 to the 10th day of October 1854 And the said Joshua Gray for himself his executors and administrators all and singular the said property heretofore described and by these presents granted bargained and sold and any part thereof unto the said Samuel D. Lynch his executors administrators and assigns against him the said Joshua Gray his executors and administrators and against all and every other person or persons shall and will warrant and defend by these presents In Witness whereof the said Joshua Gray hath hereunto set his hand and affixed his seal the day herein before first written Signed sealed & delivered in Joshua Gray (seal) the presence of J W Hunter State of Maryland Anne Arundel County to wit Be it remembered and it is hereby certified that on this seventeenth day of October in the year eighteen hundred and forty nine before me the subscriber one of the Justices of the peace of the state of Maryland in and for Anne Arundel County aforesaid personally appeared Joshua Gray and acknowledged the foregoing mortgage or instrument of writing to be his act and deed In Testimony whereof I have hereunto subscribed my name on the day and year aforesaid J. W. Hunter Recorded on the 17th day of October 1849 Deld S D Lynch 17th Sept 1850 Cost $1.37½ paid
receipt whereof is hereby acknowledged have given granted bargained and sold and by these presents doth give grant bargain and sell unto the said Ephraim W. Hall the following described negroes to wit one negro man or lad named Daniel and one negro girl named Jane To Have and to Hold all and singular the said negroes herein before granted bargained and sold or mentioned or intended so to be unto the said Ephraim W. Hall his executors administrators and assigns to the only proper use and behoof |
