334 of the City of Baltimore and state aforesaid at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain and sell unto the said Edward Reynolds (surviving partner as aforesaid) his executors administrators and assigns the following negroes viz Rachel aged twenty nine years girl Sophronia aged eighteen years boy Tom aged ten years and girl Mary aged six years To Have and to Hold the said described four negroes Rachel Sophronia Tom and Mary unto the said Edward Reynolds (surviving partner as aforesaid) his executors administrators and assigns against me the said John H Somervill my executors and administrators and against all and every other person or persons whatsoever shall and will warrant and forever defend by these presents. Provided nevertheless and it is the true intent and meaning of these presents and if the said parties hereto that in case I the said John H. Somervill my executors or administrators shall well and truly pay and satisfy to the said Edward Reynolds (surviving partner of Joseph W. & Edward Reynolds as aforesaid) his executors administrators or assigns the said sum of one thousand dollars lawful money as aforesaid with interest for the same on or before the twenty seventh day of March next then the Bill of Sale and every matter and thing herein expressed shall be null and void it being the true intent and meaning thereof that the said described negroes Rachel Sophronia Tom and Mary are mortgaged by me the said John H. Somervill to the said Edward Reynolds (surviving partner as aforesaid) to secure to the said Edward Reynolds (surviving partner as aforesaid) his executors administrators or assigns the payment of the said sum of one thousand dollars In Witness whereof I have hereunto set my hand and seal this 27th day of March eighteen hundred and forty nine Signed sealed and delivered in J H Somervell (seal) the presents of H. R. Robbins State of Maryland Baltimore City sct. Be it remembered that on this twenty seventh day of March eighteen hundred and forty nine before me the subscriber a Justice of the peace of the state of Maryland in and for the City of Baltimore aforesaid personally appears M.r John H Somervill and acknowledged the above instrument of writing to be his act and deed according to the true intent and meaning thereof and at the same time and place also personally appears Mr Edward Reynolds surviving partner of Joseph M & Edward Reynolds) party grantee to the within instrument of writing and made oath on the Holy Evangely of Almighty God that the consideration set forth in the within mortgage Bill of Sale is bona fide and true as therein set forth Acknowledged and sworn before H. R. Robbins State of Maryland Baltimore County sct I hereby certify that Henry R. Robbins Esquire before whom the annexed acknowledgment was made and who has thereto subscribed his name was, at the time of so doing a Justice of the peace of the state of Maryland in Sent to Balt to grantee by mail Decr 22d 1849 |
