323 C. Williams parties grantor and grantee in the above instrument of writing and acknowledged the same to be their act and deed for the purposes therein mentioned. Also at the same time and place the said Edward C. Williams party grantee therein named made oath on the Holy Evangely of Almighty God that the consideration therein set forth is true and bona fide as therein stated. Acknowledged & sworn before Owen M. Taylor J. P. Received March 7.th 1849 one dollar for stamp duty on this instrument Jos H Nicholson Clk Recorded on the 7.th day of March 1849 Cost 75 paid
from John Wood trustee for the sale of the real estate of Joseph J Harrison deceased a certain tract of land lying in Anne Arundel County aforesaid for which the said John H Somervell gave his bond to the trustee aforesaid amounting to the sum of four thousand five hundred dollars or thereabouts and the said William H S. Boswell and Lewis Griffith are his sureties on the said Bond and to secure the said William H. S. Boswell and Lewis Griffith from any damage or loss by reason thereof the said John H Somervell is willing to execute these presents. Now this Indenture witnesseth that the said John H. Somerville for and in consideration of the premises and of the sum of one dollar current money to him in hand paid by the said William H. S. Boswell and Lewis Griffith at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said William H. S. Boswell and Lewis Griffith their executors administrators and assigns all and singular the negro slaves hereinafter particularly mentioned and expressed: that is to say the negroes names as follows to wit: John aged thirty five years Margaret his wife aged twenty eight years Winny thirteen years Charles eight years Sarah six years Alice three years these are all of one family. Robert twenty years Watt twenty five years Samuel twelve years Jane fifteen years the two last brother and sister: To Have and to Hold all and singular the said negro slaves unto the said William H. S. Boswell and Lewis Griffith their executors administrators and assigns and to their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said John H Somerville or his heirs executors or administrators do and shall well and truly pay or cause to be paid the sum or sums of money due for the land aforesaid with the interest thereon accruing and shall save the said William H. S. Boswell and Lewis Griffith and their heirs executors administrators free from any loss damage or harm by reason of their suretyship as aforesaid then and in such case |
