307 and assigns doth covenant and promise and agree to and with the said Franklin Carrick his heirs executors and administrators that he will well and truly pay to him the full and just sum of three hundred dollars on the first day of January in the year eighteen hundred and forty eight In Witness whereof the said Benjamin Carrick hath hereunto set his hand and seal the day and year aforesaid In presence of Benjamin Carrick (seal) Jo.s Nicholson Rebecca E Nicholson Maryland Anne Arundel County to wit Be it remembered that on this 27 day of Sep.r in the year of our Lord one thousand eight hundred & forty eight before me ^one of^ the Justices of the peace of the County & State afs.d appears Benjamin Carrick and acknowledged the foregoing writing to be his act and deed according to the true intent and meaning thereof and the act of assembly in ^such^ case made and provided Witness my hand Jos Nicholson Sep.r 27 1848 I do hereby certify that the within mentioned Benjamin Carrick is personally known to me to be the identical person professing to have signed and sealed the same Witness my hand Jos. Nicholson J Peace A. A. County Maryland A. A. County to wit On this 27.th day of Sep.r 1848 came the within mentioned Benjamin Franklin Carrick before me a Justice of the peace for said county and made oath on the Holy Evangelists of Almighty God that the facts set forth in the within and aforegoing instrument of writing is just and true & for a bona fide & valuable consideration Witness my hand Jos Nicholson J. Peace A A County Recorded on the 10.th day of October 1848 Cost $1.10
to be one of the sureties on the official Bonds of the said Joseph H Nicholson as clerk of Anne Arundel County Court and the said Joseph H Nicholson as desirous of making some provision for his wife and children after indemnifying the said Randall and saving him harmless from all loss damage or costs that he may sustain by reason of his suretyship as aforesaid and for those purposes is desirous of executing these presents. Now this Indenture witnesseth that the said Joseph H. Nicholson for and in consideration of the premises and for and in consideration of the sum of one dollar current money of the United States to him in hand paid by the said Alexander Randall at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Alexander Randall his executors administrators and assigns all and singular the goods and household furniture hereinafter more particularly described now in the dwelling house of the said Joseph H. Nicholson |
