300 Fitzhugh Worthington by his promissory note dated first day of June eighteen hundred and forty eight and payable on the first day of June eighteen hundred and forty nine stands indebted to the said Richard C. Mackubin in the sum of two thousand dollars current money and to secure the payment thereof with interest is willing to execute these presents. Now this Indenture witnesseth that the said Charles Fitzhugh Worthington for and in consideration of the premises and for and in consideration of the premises sum of one dollar current money to him in hand paid by the said Richard C. Mackubin at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Richard C. Mackubin his executors administrators and assigns the following negroes slaves for life viz. Thomas Hinson aged fifty seven years David Young aged fifty one years Henry Ready aged forty four years Thomas Blackiston aged twenty four years, Jerry Blackiston aged thirteen years John Wesley Chase aged five years Elizabeth Taylor aged twenty eight years and her three children Anne Elizabeth Sarah Jane and Lloyd Washington Delia Blackiston aged twenty years Eliza Blackiston aged fourteen years and her son Horace aged four months and Jane Wilson aged two years To Have and to Hold the said negroes slaves for life hereinbefore granted bargained and sold unto the said Richard C. Mackubin his executors administrators and assigns to the only proper use and behoof of the said Richard C. Mackubin his executors administrators and assigns forever. Provided Always and it is the true intent and meaning of these presents that if the said Charles Fitzhugh Worthington his executors administrators or assigns do and shall well and truly pay or cause to be paid with the said Richard C. Mackubin his executors administrators or assigns the full sum of two thousand dollars current money with legal interest for the same on or before the first day of June eighteen hundred and forty nine then and in such case these presents and every matter and thing herein contained shall cease and be utterly null and void any thing herein contained to the contrary thereof in any wise notwithstanding And the said Charles Fitzhugh for himself his heirs executors and administrators doth covenant, promise ^grant^ and aquit and with the said Richard C. Mackubin his heirs executors administrators and assigns that he the said Charles Fitzhugh Worthington his heirs executors or administrators or some of them shall and will well and truly pay or cause to be paid unto the said Richard C. Mackubin his heirs executors administrators or assigns the said sum of two thousand dollars with legal interest as aforesaid on the day hereinbefore limited for the payment of the said principal and interest, without any deduction or abatement whatsoever. And the said Charles Fitzhugh Worthington for himself his executors and administrators the said negroes slaves for life by these presents bargained and sold unto the said Richard C. Mackubin his executors administrators and assigns against him the said Charles Fitzhugh Worthington his executors and administrators and against all and every other person and persons whatsoever shall and will warrant and forever defend by |
