296 mortgagees and severally make oath on the Holy Evangely of Almighty God that the consideration set forth in the aforegoing deed of mortgage is true and bona fide as therein set forth. In Testimony whereof I hereto subscribe my name on the day and year aforesaid Walton Gray State of Maryland Baltimore County sct I hereby certify that Walton Gray gentleman before whom the within and aforegoing acknowledgment and affidavit were made and who has hereto subscribed his name was at the time of so doing a Justice of the peace of the state of maryland in and for the City of Baltimore duly commissioned and sworn In Testimony whereof I hereto subscribe my name (Seals) and affix the seal of Baltimore County Court the thirtieth day of August (Place) in the year eighteen hundred and forty eight A W Bradford Clerk of Baltimore County Court Recorded on the 19.th day of September 1848 ex.d & del.d to George R. upon Thomas J Hall & son in favor of John Hurst for the sum of seven hundred and fifty dollars duly stamped according to law and payable to the order of said Hurst four months after date thereof And these presents are executed to secure said Thomas J hall & son against all loss that may accrue to them by reason of their acceptance of said draft and to secure the payment thereof above the same shall fall due. Now this Indenture witnesseth that in consideration of the premises and for the sum of one dollar the said George W Nutwell hath bargained and sold and doth hereby grant, bargain, sell and assign convey unto said Thomas J. Hall & son all the Tobacco now in the house upon the plantations of said Nutwell in Anne Arundel County aforesaid, estimated to be about twenty hogsheads and also the crop of wheat that may be produced on said farm from eighty bushels of wheat more or less that are now about to be sowed thereon. To Have and to Hold the same unto said Thomas J Hall his executors administrators & assigns Provided however that if said draft shall be paid by said Nutwell at maturity thereof then these presents shall be void but if said Thomas J Hall & son shall not be furnished by said Nutwell with funds to pay said draft at maturity and shall thereby be compelled to pay it themselves then it shall be lawful for said Thomas J Hall or his legal representatives to sell and dispose of the property hereby mortgaged in hs or their discretion and after paying all costs and charges that may have been incurred and deducting the amount of said draft and interest to account for any surplus of proceeds to said Nutwell or his legal representatives.
