Sandsbury and Arena Jane his wife owes and stands justly indebted to the said Godfrey Friedhofer, in the sum of twenty eight dollars, current money, and to secure the payment thereof is willing to execute these presents. Now this Indenture witnesseth that the said William Sandsbury and Arena Jane his wife for and in consideration of the premises and of the sum of one dollar current money to them in hand paid by the said Godfrey Friedhofer at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged hath granted bargained and sold and by these presence doth grant bargain and sell unto the said Godfrey Friedhofer, his executors administrators and assigns all and singular, that is to say one negro girl named Sarah. To Have and To Hold all and singular the said negro woman named Sarah, unto the said Godfrey Friedhofer his executors administrators and assigns to his and their own use and behoof. Provided always and it is declared to be the true intent and meaning of these presents, that if the said William Sandsbury and Arena Jane his wife do and shall well and truly pay or cause to be paid unto the said Godfrey Friedhofer, his executors administrators or assigns the full sum of twenty eight dollars current money with legal interest for the same on or before the eighth day of February eighteen hundred and forty nine, then and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes anything herein contained to the contrary notwithstanding: and the said William Sandsbury and Arena Jane his wife for themselves their heirs executors and for ever of them doth covenant promise and agree to and with the said Godfrey Friedhofer his executors and administrators, the said sum of twenty eight dollars current money together with interest for the same after the rate aforesaid at such time and after the manner hereinbefore set forth and agreed for the payment thereof. And it is the express agreement that upon the payment of the said sum of twenty eight dollars with legal interest for the same on or before the day aforesaid this mortgage shall be void anything herein to the contrary notwithstanding; but if default shall be made in the said principal Debt or the interest which shall accrue |
