part and George Mcculloh William Mcculloh & Hiram Mcculloh of the other part. Witnesseth that the said party of the first part owes and stands justly indebted to the said parties of the second part in the sum of three thousand six hundred dollars current money and to secure the payment thereof is willing to execute these presents Now this Indenture witnesseth that the said party of the first part for and in consideration of the premises and for and in consideration of the sum of five dollars current money to him in hand paid by the said parties of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained & sold and by these presents doth grant bargain and sell unto the said parties of the second part their Executors administrators or assigns all and singular the goods furniture and household stuff herein after mentioned in a schedule hereto attached To Have and To Hold all and singular the goods furniture and household stuff herein before granted bargained and sold or mentioned or intended so to be unto the said parties of the second part their Executors Administrators or assigns to the only proper use and behoof of the said parties of the second part their Executors Administrators and assigns forever Provided always and these presents are upon the condition that if the said party of the first part his executors or administrators shall and do well and truly pay or cause to be paid unto the parties of the second part their Executors administrators or assigns the full and just sum of three thousand six hundred dollars current money on or before the fifteenth day of March in the year one thousand eight hundred and forty six then and in such case these presents and every matter and thing herein contained shall cease determine & be utterly void to all intents and purposes any thing herein contained to the contrary thereof in any wise |
