26 assigns all the right title interest & Estate of him the said Rousby M. Thomas in and to the Hull of the Schooner Mary and Thomas together with all and singular hereinafter yards sails Rigging Anchors cables boats tackle apparel and appurtenances as she now his which said vessel us more particularly described in a bill of sale from James Swamstead Samuel H Whittington and Zebalon Mitchell to the said Levi Gardiner dated the fifth day of November eighteen hundred and forty two as will more fully and at large appear and reference being thereto had. To Have and To Hold the said schooner together with all and singular the tackle and appurtenances aforesaid unto him the said Levi Gardiner his Executors administrators or assign forever. Provided always and these presents are upon the express condition that if the said Rousby M. Thomas his executors or administrators shall well and truly pay or cause to be paid unto the said Levin Gardiner his Executors administrators or assigns the aforesaid sum of three hundred dollars current money of the United States with legal interest thereon at the time herein before specified for the payment thereof then these presents and every matter and thing herein contained shall cease determine & be utterly null and void anything herein contained to the contrary thereof in anywise notwithstanding. In Testimony whereof the said Rousby M Thomas hath hereunto subscribed his name & affixed his seal the day and year herein before first written Witness J. B. Belt Rousbury M. Thomas (seal) At the foot of the foregoing was thus written to wit State of Maryland Prince Georges County Sct. Be it remembered that on this fifteenth day of May Anno Domini 1845 before the Subscriber a justice of the peace of the said State in and for said County personally appeared the above named Rousby M Thomas who is personally known to me to be the grantor in the aforegoing deed or instrument of writing and who signed and sealed the same as such and acknowledged the said deed or instrument of writing to be his act and deed for the purposes therein mentioned according to law Acknowledged before & certified by J. B. Belt J. Peace Maryland Sct. I hereby certify that James B. Belt Gentleman before whom the within acknowledgment appears to have been made was on the day of the date thereof and [illegible] is one of the said States Justices of the peace in and for Prince |
