Arnold of the County and State of the other part Whereas Elijah R Arnold has become security for Passmore McCullough on two promissory notes bearing date the ninth day of April eighteen hundred and forty seven one for seventy five dollars payable in six months after date and one for fifty dollars payable in seven months after date and which said notes are drawn in favour of James Jones of the County and State aforesaid and made payable to the said James Jones or his order with legal interest from the date thereof and which said notes or obligations are jointly signed and executed by the said Passmore McCullough and Elijah R Arnold. And whereas the said John Dougherty did promise and agree with the said Elijah R Arnold that in consideration of his becoming security as aforesaid for the said Passmore McCullough on the notes aforesaid to execute these presents. Now this Indenture witnesseth that in consideration of the above recited premises and of the sum of five dollars current money to him in hand paid by the said Elijah R Arnold the receipt whereof the said John Dougherty doth hereby acknowledge and thereof and therefrom doth acquit release exonerate and forever discharge the said Elijah R Arnold his heirs executors and administrators and every of them by these presents and for and as collateral and further security unto the said Elijah R Arnold for the more sure payment of the said sums of money mentioned in said notes or obligations being one hundred and twenty five dollars with interest from their date according to the condition of the said notes or obligations by these presents he the said John Dougherty hath granted bargained sold assigned transferred and set over and by these presents doth grant bargain sell assign transfer and set over to the said Elijah R Arnold all the schooner or vessel called called the Hills point of Annapolis and now lying in port of the City of Annapolis whereof he is declared to be owner aforesaid and also of and in all and singular the masts sails standing and running rigging ropes cables anchors tackel apparel furniture and appurtenances whatsoever to the said schooner or vessel belonging which said schooner or vessel has been duly registered according to law to have and to hold the said schooner or vessel called the Hills point of Annapolis and all the other above bargained premises with the appurtenances rents the said Elijah R Arnold his executors administrators assigns to his and their own use and uses and as his and their own proper goods and chattels from henceforth forever. Provided always and these presents are upon the express condition that if the said Passmore McCullough his heirs executors and administrators do and shall truly pay or cause to be paid unto the said James Jones his heirs executors |
