City of Baltimore in the State aforesaid of the other part whereas at the instance and request and for the benefit and accommodation of the party hereto of the first part the parties hereto of the second part in their copartnership name of Ignatius Pike & Penn have become the acceptors of a certain draught or Bill of Exchange of even date herewith drawn by said Francis Brashears to and in favour of Benjamin Harrison Junior or order for the sum of five hundred dollars and interest payable at six months after date to secure the payment of which said draught or Bill of Exchange at maturity by the said Francis Brashears or his representatives this Instrument is executed Now this Deed Witnesseth that for and in consideration of the premises and of the sum of one dollar lawful money to the party hereto of the first part paid by the the parties of the second part to these presents at or before the sealing and delivery hereof the receipt of which is hereby acknowledged the said Francis Brashears hath bargained sold and made over and doth hereby bargain sell and make over unto the said Ignatius Pike and Penn their Executors administrators and assigns all the crop of tobacco of the said Francis Brashears now in hand supposed to be about twenty five or thirty hogsheads also a negro Boy named Jacob aged about sixteen years and also one other negro boy named Tom also aged about sixteen years. To Have and To Hold the same unto and to the use of the said Ignatius Pike and Alexander Penn their Executors administrators and assigns as joint tenants and not as tenants in common forever. Provided always and these presents are upon this condition that if the said Francis Brashears his Executors administrators or assigns shall well and truly pay take up and retire at maturity the draught or Bill of Exchange herein before referred to and recited and do and shall deliver up the same to the parties hereto of the second part or their representatives to be cancelled then this Instrument and every matter and thing herein shall be utterly null and void to every intent and purpose whatsoever But if default be made in the payment of the said draught or Bill of Exchange at its maturity then these presents are declared to be made.
