134 third day of October in the year eighteen hundred and forty six between George M. Duvall of Anne Arundel County in the state of Maryland of the one part and William O' Hara of the same County and State of the other part. Whereas the said William is an endorser on two promissory notes drawn by the said George M. Duvall one of said notes dated the twenty third day of May eighteen hundred and forty six payable at twelve months from date thereof in the sum of five hundred dollars and now supposed to be held by one Thomas M. Locke and the other of said notes dated the fourth day of October eighteen hundred and forty six payable ninety days from the date thereof in the sum of three hundred dollars now supposed to be held by the Farmers Bank of Maryland And whereas it is the intention of the instrument of writing to defend save harmless and indemnify the said William O' Hara against any loss which he may sustain by reason of his liability as endorser as aforesaid. Now this Indenture Witnesseth that the said George M. Duvall for and in consideration of the premises and of the sum of five dollars current money to him in hand paid by the said William O' Hara at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said William O' Hara his executors administrators and assigns all and singular the goods chattels and property hereinafter particularly mentioned and expressed that is to say the following property now on the farm on South River Neck on which the said George M. Duvall now resides to wit the crop of tobacco now in the house the crop of corn now standing the wheat now upon the ground four horses two yoke of oxen three cows and four head of sheep To Have and To Hold all and singular the said goods chattels and property unto the said William O' Hara his executors administrators and assigns to his and their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said George M. Duvall shall defend save harmless and indemnify the said William O Hara against all and any loss which he may sustain by reason of his liability as endorser as aforesaid or which his executors administrators or assigns may sustain by reason of said endorsements and shall satisfy and pay to the persons entitled to receive the same the sums of money in the said two notes respectively specified together with the interest that may be due thereon then and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes anything herein contained to the contrary notwithstanding.
