executors administrators and assigns forever  Provided and it is the true intent
and meaning of these presents that the said Passmore McCullough shall
continue to possess use and manage the said ferry Boats and to receive the
tolls and profits of the same as heretofore and the same when collected and received
to apply and lay out in the following manner two thirds of the same to
expend and apply in the payment of the costs and expenses in and
about the use employment and navigation of the said boats and the
residue equally to divide between the said Passmore for his trouble case
and attention in the management and navigation of said boats and
the said William Hiram and George McCullough in payment of the said
sums due to them as aforesaid rateably and in equal proportions  And it
is the further intent and meaning of these presents that the said
Passmore McCullough shall retain the said stock in trade goods
wares and merchandize already in possession and which shall hereafter
come unto his possession as above mentioned for the purpose of
sale and retail as heretofore and when sold and retailed to receive
and collect the prices thereof and to apply and pay over the receipts
profits and value to the following purposes first one fourth thereof
to the payment of the costs and expenses in and about the keeping
and retailing the said goods wares and merchandizes and all other
charges and liabilities reasonably incurred in the carrying out the business
aforesaid and secondly to retain one fourth part thereof in payment to
the said Passmore McCullough for the care trouble and skill in and about
the said business bestowed and thereby to apply and pay over the residue
in equal proportions to the payment of the said sums due as aforesaid
to the said William Hiram and George McCullough respectively
in rateable and equal proportions and to the purchase of other goods
wares and merchandize to be held sold retailed as aforesaid and the
receipts and profits and prices thereof to apply and pay over in the
order manner and proportion just mentioned  Provided always
it is the further intent and meaning of these presents and the parties
hereunto that upon the payment of the sums of money aforesaid
and not before these presents shall cease and every part and parcel
thereof in regard to all goods and chattels wares merchandizes
rights and credits within the view and intent of the same shall
become utterly null and void and all such goods and chattels
wares merchandizes rights and credits shall become the absolute
right and property of the said Passmore McCullough as before the
execution hereof  In Witness whereof the said Passmore McCullough
has hereunto set his hand and seal this sixteenth day of November
eighteen hundred and forty six
