103 the said Nicholas Owens in consideration of the said debt or sum of one hundred dollars owing to the said James Owens Senior as aforesaid and for the better securing the payment thereof with interest to the said James Owens Senior his executors administrators or assigns according to the condition of the said obligation as also in consideration of the said securityship entered into by the said James Owens Senior and for the effectual securing the said James Owens Senior his heirs and assigns from any loss or damage caused by the said Nicholas Owens failing to pay unto the said Alexander Randall his heirs or assigns the said sum of three hundred and twenty five dollars current money with legal interest thereon on or before the ninth day of March in the year of our Lord one thousand eight hundred and forty eight and also in further consideration of the sum of five dollars current money to him the said Nicholas Owens by the said James Owens senior in hand well and truly paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged by the said Nicholas Owens hath granted bargained and sold released and confirmed and by these presents doth grant bargain and sell release and confirm unto the said James Owens Senior his heirs and assigns two negro Girls purchased by him the said Nicholas Owens from the said Alexander Randall that is to say one negro girl named Eliza aged on or about seven years and one negro Girl named Louisa aged on or about thirteen years together with each and severally of their increase. To Have and To Hold the said negroes with severally their increase untill they shall severally arrive at the age of thirty five years old to the said James Owens Senior his heirs and assigns to his and their own use and behoof provided always and it is the true intent and meaning of these presents and of the said parties hereunto that if the said Nicholas Owens his heirs Executors or administrators do and shall well and truly pay or cause to be paid unto the said James Owens Senior his Executors administrators or assigns the said full sum of one hundred dollars current money with legal interest for the same on or before the first day of April in the year of our Lord one thousand eight hundred and forty eight without any deduction or abatement whatsoever and provided furthermore that the said Nicholas Owens his heirs executors or administrators do and shall well and truly pay or cause to be paid unto the said Alexander Randall his executors administrators or assigns the said full sum of three hundred and twenty five dollars current money with legal interest thereon on or before the ninth day of March in the year of our Lord one thousand eight hundred and forty eight without any deduction or abatement whatsoever so as to save the said James Owens Senior his heirs executors or administrators from any harm damage |
