and agreed to be the true intent and meaning of these presents that the said
Edwin P Hayden and William J Timanus and the survivor of them and the
executors and administrators of such survivor shall stand possessed of and
interrested in the moneys to arise from such sale or sales and to be called
in and received as aforesaid upon trust and to the intent that they or he
shall and do in the first place pay and retain to and reimburse themselves
or himself all such Costs Charges and expenses as they respectively or he
shall or may sustain or expand in and about such sale or sales so to be made
as aforesaid and do and shall thereout also pay the expenses of preparing
and Executing these presents and all other costs charges and expenses
incident to or which may be incurred or sustained in or about the
execution of the trusts herein expressed or any of them and then in trust
that they the said Edwin P Hayden and William J Timanus and the
survivor of them or the executors and administrators of such survivor do and
shall apply the rest and residue of said trust moneys in and towards payent
and satisfaction of the debts and sums of money due to such creditors of the said
Ambrose B Owens as shall within fifteen days from and after the date
of these presents execute and deliver to the said Ambrose B Owens a legal
and valid release of the several debts due them and all actions suits claims
and demands or accounts thereof disbursing the said moneys among the
said releasing creditors paro passu and without any prefference or
priority of payment and after payment of all said debts Costs and Charges
then in trust that they the said Edwin P Hayden and William J Timanus
or the survivor of them his Executors administrators do and shall pay over
the surplus of said trust moneys (if any) to the said Ambrose B Owens his
Executors administrators or assigns and for the considerations and purposes
aforesaid the said Ambrose B Owens has made Constituted and appointed
and by these presents doth make Constitute and appoint the said Edwin P
Hayden and William J Timanus and the survivor of them and the Executors
and administrators of such survivor his true and Lawful attorneys and
attorney jointly and severally in the name of the said Ambrose B Owens
or otherwise to adjust settle and liquidate all accounts relating to the premises
and to collect get in and use and take all legal or equitable means for
the recovery and receipts of all debts and sums of money mentioned to be
hereby assigned as aforesaid and upon receipts acquittances and other
effectual discharges for the same or so much thereof respectively as shall
be received to make sign seal and deliver and to Compound for any
bad or dubious debt or debts and one or more attorney or attorneys
