72 party to the foregoing deed or indenture and doth acknowledge the same to be his act and deed In witness whereof I hereunto subscribe my name on the day and year aforesaid Exd d d Jacob Bradenbaugh $.72 6 Recorded the 11th day of December 1839 This Indenture made this twenty second day of November in the year of our Lord one thousand Eight hundred and thirty nine by and between Ambrose B Owens of Anne Arundel County and state of maryland of the one part and Edwin P Hayden and William J Timanus of the County and state aforesaid trustees as herein after mentioned of the other part to wit whereas the said Ambrose B Owens is indebted unto various persons in divers sums of money and being unable to pay the whole of such debts has proposed and agreed to assign all his Estate and effects unto the said Edwin P Hayden and William J Timanus for the benefit of the Creditors in the manner and upon the Conditions hereinafter mentioned Now this Indenture witnesseth that the said Ambrose B Owens in pursuance and performance of the said proposal and agreement and in consideration of the release hereinafter mentioned and of the sum of one dollars Current money to him in hand paid by the said Edwin R Hayden and William J Timanus at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath bargained sold assigned transferred and set over and by these presents doth bargain sell assign transfer and set over unto the said Edwin P Hayden and William J Timanus their Executors administrators and assigns all and singular the stock in trade debts sums of money books of accounts and other things due and owing to the said Ambrose B Owens and all the personal Estate whatsoever of him the said Ambrose B Owens and all his Estate and interest therein to have hold receive perceive and take the same unto the said Edwin P Hayden and William J Timanus their Executors administrators and assigns upon trust that they or the survivor of them and the Executors or administrators of such survivor do and shall as soon as conveniently may be make sale and dispose of so much and such parts thereof as are in their nature saleable for the best prices in money that can be reasonably had or obtained for the same and do and shall collect and get in so much thereof as I may be outstanding and not in their nature saleable and it is hereby declared (and) |
