348 D Sutton his Executors administrators and assigns the following property vizt one third of a Crop of Tobacco now in the ground supposed to be two thousand for one third part and also grain now growing Corn & Oats and one bay horse about Eight years old To have and To hold the same described property above bargained and sold to the said Phillip D Sutton his Executors administrators and assigns for ever to his and their only proper use and benefit and I the said Jas Turner for myself my Executors and administrators shall and will warrant and forever defend by these presents the said P D Sutton his Executors administrators and assigns the said described property against me my Executors and administrators and against all and every other person or persons whomsoever claiming or to claim the same or any part thereof In Testimony whereof I have hereunto set my hand and affixed my seal this thirty first day of July in the year of our Lord One thousand Eight hundred and forty four Signed Sealed and delivered in the presence Joseph Turner (seal) of Lewis Sutton Sr A E Dill On the back of the aforegoing was thus written to wit State of maryland Anne Arundel County to wit On this 31st day of July 1844 Before me one of the Justices of the peace in and for the State and County aforesaid appears Joseph Turner and acknowledges the foregoing writing to be his act and deed and the property therein named to be the right and Estate of the within named Phillip D Sutton upon the condition only therein declared as Collateral security for the money therein described and no other according to the true intent and meaning of the same and the Act of Assembly in such case made and provided Acknowledged before Lewis Sutton Sr chd 63 4½ Recorded the 5th day of August 1844 This Indenture made this twenty ninth day of July Eighteen hundred and forty four Between Joseph R Dunning of Anne Arundel County and State of maryland of the one part and Caleb A Townsend of the City of New york and State of New York of the other part Whereas the said Joseph R Dunning owes and stands justly indebted to the said Caleb A Townsend in the sum of six hundred dollars current money and to secure the payment thereof is willing to Execute these presents Now this Indenture Witnesseth that the said Joseph R Dunning for and in consideration of the premises and of the sum of five dollars Current money to him in hand paid by the said Caleb R Townsend at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Caleb A Townsend his Executors (administrators) |
