335 hundred and fifty dollars dated the Eighth day of may in the year Eighteen hundred and forty four at sixty days and discounted at the Farmers Bank of maryland And whereas the said James H Watkins is and was to secure the payment of the aforesaid sum of one hundred and fifty dollars so as aforesaid due and owing from the said James H Watkins to the said John Watkins and also to save harmless from harm and loss the said John Watkins by reason of his endorsement as aforesaid and by reason of my subsequent endorsements by the said John Watkins for or on account of the said note or my renewals thereof or substitutes therefor hath agreed to Execute this instrument of writing Now this Indenture Witnesseth that the said James H Watkins for and in consideration of the premises and for and in consideration of the sum of one dollar Current money to him in hand paid by the said John Watkins at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John Watkins his Executors administrators and assigns all my household and kitchen furniture and all my goods wares and merchandizes the Store house occupied by me in Cornhill Street and consisting of all boots or bonnets for ladies ribbons laces gloves and so forth To have and To hold the sum unto the said John Watkins his Executors administrators and assigns to his and their only proper use and behoof of the said John Watkins his Executors administrators and assigns for ever provided always and it is the true intent and meaning of this instrument of writing that if the said James H Watkins shall well and truly pay over or to be paid to the said John Watkins his Executors administrators or assigns the said sum of one hundred and fifty dollars at such times and in such sums as the said John Watkins shall acquire And shall also well and truly save from harm and loss the said John Watkins by reason of his endorsment as aforesaid then this instrument of writing to be void otherwise to remain in full force and virtue in Law In Witness whereof the said James H Watkins hath hereunto set his hand and seal the day and year first herein written James H Watkins (seal) Signed Sealed and delivered in the presence of Wm Glover At the foot of the aforegoing was thus written to wit State of maryland Anne Arundel County to wit On this sixth day of June in the year Eighteen hundred and forty four before me the subscriber a Justice of the peace of the said State in and for said County personally appears James H Watkins he being known to me to be the Identical person named and described as now professing to be party grantor in the aforegoing instrument of writing and acknowledges the same to be his act and deed Wm Glover chd 78 8 Recorded the 6 day of June 1844 Delvd to Jno H Watkins Jany 22d [illegible] |
