316 This Indenture made this fifteenth day of January in the year Eighteen hundred and forty four Between Hamilton Bowie of Anne Arundel County Maryland of the one part and George D O Gowan of said County and State of the other part Whereas the said Hamilton Bowie stands indebted to the said George D O Gowan in the sum of one thousand dollars with interest thereon from the first day of September last And whereas the said Gowan hath indorsed a note drawn by the said Bowie and discounted at The Farmers Bank of Maryland at Annapolis for the sum of three hundred and seventy five dollars dated fifteenth day of November last and for the accommodation of the said Bowie which may be renewed And whereas it is the purpose of these parties and the object of these presents to secure and indemnify the said Gowan in the premises Now this Indenture Witnesseth that the said Bowie for and in consideration of the premises and for and in Consideration of the sum of Ten dollars Current money in hand paid by the said Gowan the receipt whereof the said Bowie acknowledges hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Gowan his Executors administrators and assigns the following Chattels and personal Estate namely One Negro man named Jim about thirty years old, One Negro woman named Asmin about forty years old and her three Children Viz Henry a boy nine years old, Joe a boy six years old, Frederick a boy two years old, also one woman Julia twenty five years old, One woman Rebecca twenty seven years old and his two Children Viz William a boy four years old and John an infant six months old together with all the horses cattle sheep Hogs farming utensils Buggy and harness household and kitchen furniture of the said Bowie now in his possession on his farm in Anne Arundel County To have and To hold the same unto the said Gowan his Executors administrators and assigns for ever Provided nevertheless that if the said Hamilton Bowie his Executors administrators and assigns do and shall well and truly pay to the said Gowan his Executors administrators or assigns the said sum of one thousand dollars within three months from the date of these presents with the Interest due thereon till paid and do and shall well and truly well and truly save harmless and indemnify the said Gowan on account of his indorsement aforesaid and on account of my indorsement upon a renewal of or substitute for said Note either for the whole or any part thereof then and in that case these presents and every matter and thing therein Contained shall be utterly null and void otherwise to be and remain in full force and virtue And the said Hamilton Bowie for himself his heirs Executors and administrators doth hereby Covenant with the said Gowan his Executors administrators and assigns to pay to the said Gowan his Executors administrators and assigns the said sum of one thousand dollars as aforesaid In testimony (whereof) |
