304 for the sum of two hundred and fifty dollars dated the day of November in the year Eighteen hundred and forty three and payable sixty days after the date thereof which said Note has been discounted at the Farmers Bank of Maryland and may be [illegible] from time to time at the pleasure of said institution And whereas also the said Gilbert Murdock and Basil Shephard are indorsers upon three other several promissory notes of the said William Murdock each dated the twenty fourth day of November in the year Eighteen hundred and forty three each for the sum of two hundred dollars one payable in four months one in Eight and the other in twelve months from this date as aforesaid: And whereas also the said William Murdock is and was to save from loss the said Gilbert Murdock and Basil Shephard by reason of these indorsements as aforesaid and the better to secure the payment of the several sums of money specified in the said several promissory notes is willing to Execute these presents Now this Indenture Witnesseth that the said William Murdock for and in consideration of the premises and for and in consideration of the sum of five dollars Current money to him in hand paid by the said Gilbert Murdock and Basil Shephard at or before the sealing and delivery hereof the receipt whereof is hereby acknowledged hath granted bargained and sold and by these doth grant bargain and sell unto the said Gilbert Murdock and Basil Shephard their Executors administrators and assigns the goods wares and merchandize of the said William Murdock Consisting of Groceries, China ware and dry goods and other articles of merchandize now in the Storehouse situated in Main Street in the City of Annapolis at present occupied by the said William Murdock and such other goods wares and merchandize as may from time to time come to the possession of the said William Murdock as his property together with the household and kitchen furniture of the said William Murdock To have and To hold the said goods wares and merchandize and the said household and kitchen furniture unto the said Gilbert Murdock and Basil Shephard their Executors administrators and assigns for ever Provided nevertheless and it is the true intent and meaning of these presents that if the said William Murdock shall well and truly retire and pay the said several promissory notes as they may fall due and shall also well and truly retire and pay all and any substituted therefor or renewals thereof and all Costs and expenses that may accrue thereon and shall also save harmless the said Gilbert Murdock and Basil Shephard by reason of their endorsements aforesaid then this Indenture and every matter and thing herein contained shall cease and determine otherwise to remain in full force and virtue in Law In Witness whereof the said William Murdock hath hereunto set his hand and seal the day and year first (herein) |
