289 this 25 October 1843 before me the subscriber a Justice of the peace for Anne Arundel County aforesaid personally appeared Wm F Steuart he being known to me of my own knowledge to be the persons named & described therein & professing to be the party grantor in the foregoing bill of sale or instrument of writing and acknowledged the same to be his act & deed according to the Act of Assembly made & provided in such case Gassaway Winterson Exd d d chd 7 Recorded the 25 day of October 1843 Know all men by these presents that I Thomas Stallings of Anne Arundel County for and in consideration of Samuel Davis being my supersedas on a Judgment recovered against me by Robert Plummer for Thirty five dollars with Interest & Costs thereon and in five this Consideration of my being justly indebted on note of hand to the said Samuel Dove for fourteen dollars and seventy cents and the additional sum of one dollar to me in hand paid by the said Samuel Dove at or before the sealing and delivery of these presents the receipt whereof I do hereby acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said Samuel Dove his Executors administrators and assigns all my share of the Crop of Corn and Tobacco now on the farm where I reside three head sheep & thirteen hogs all which property is now in my possession To have and To hold the same described property above bargained and sold to the said Samuel Dove his Executors administrators and assigns to his and their only proper use and benefit And I the said Thomas Stallings for myself my Executors and administrators shall and will warrant and for ever defend by these presents to the said Samuel Dove his Executors administrators and assigns the said described property against me my Executors and administrators and against all and every person or persons whomsoever claiming the same or any part thereof provided nevertheless that in case I the said Thomas Stallings shall pay the several sums before mentioned to Robert Plummer & Samuel Dove aforesaid and bear the said Samuel Dove harmless from being my supersedas then this bill of sale to be utterly null and void otherwise to remain in full force and virtue in Law In Testimony whereof I have hereto set my hand & affixed my seal this ninth day of October 1843 Signed Sealed and delivered in his presence of Chas Hodges Thomas x Stallings (seal) mark At the foot of the aforegoing deed was thus written to wit On this 9th day of October 1843 before me the subscriber one of the Justices of the peace for the said county personally appears Thomas Stallings being known to me as the same person Executing this instrument of writing and (acknowledges) |
