288 under a bequest to them by my late Grand uncle Wm Steuart of his claim against the Estate of my deceased father Dr Chas Steuart amounting at the time to be more than six thousand dollars and the effect of which bequests was to make me indebted to my said brothers to the amount of one third of said claim have granted bargained & sold assigns transferred & made over an by these presents do grant bargain & sell assign transfer & make over unto the said Geo B Steuart & Chs C Steuart their Executors administrators & assigns respectively all the following Negroes Viz.t Hark aged 38, Davy 50, Ned 50, Washington 20 Henry 18, Thomas 20, Dick 20, Patsy aged 40, David 70, Sarah 70, Ann 20 Eliza 12, Kitty 30 & two infant children, Mary 40 & two children also all my interest in the furniture & [;ate now in my possession in the principal part of which I own and undivided third jointly with my said brothers also all my crops of Tobacco corn & grain whether housed or in the field or seeded also my carriage ten horses ten oxen three Cows two calves two ox Carts and all other farm stock & utensils of every description also all hay straw blades & fodder on my plantation To have and To hold all the said described & mentioned personal property unto the said Geo B Steuart & Chs C Steuart their Executors administrators & assigns as aforesaid in hand nevertheless & to & for the following purposes that is to say in trust to secure the payment to them of one hundred & twenty dollars per annum payable half yearly on the twenty fifth day of may & twenty fifth day of November for five years from the date & for the payment to them of the said principal sum of two thousand dollars on the twenty fifth day of November Eighteen hundred & forty Eight and these presents are upon this Condition that if the said annual sum of one hundred & twenty dollars shall be punctually paid as aforesaid and the said principal sum of two thousand dollars shall be paid on the twenty fifth day of November Eighteen hundred & forty Eight as aforesaid and if a promissory note of the said Wm F Steuart for six hundred & sixty five dollars & thirteen Cents indorsed by his Brothers & discounted for his use in the Farmers Bank of Maryland shall be paid so that his said Brothers shall be indemnified & saved harmless thereon then this instrument of writing and every matter & thing therein Contained to be null & void otherwise to be & remain in full force & virtue in Law In Witness whereof I the said Wm F Steuart have hereto affix my hand & set my seal this twenty fifth day of October Eighteen hundred & forty three Signed Sealed & delivered in the presence Wm F Steuart (seal) of Gassaway Winterson On the back of the aforegoing was thus written to wit State of maryland Anne Arundel County sc Be it remembered of (this) |
