257 presents hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Joshua Gray his Executors administrators and assigns all and singular the goods chattles and property hereafter mentioned to wit One negro boy Zachariah aged about nineteen and bound to serve until twenty one years of age three horses four Cows four steers four Heifers five hogs one ox and one horse cart and all the farming utensils now in the possession of said George W Gray three beds and furniture three tables one bureau one Clock and one watch and all the kitchen furniture belonging to him the said George W Gray and about four hundred cords of pine wood now cut & in the possession of said George W Gray To have and To hold all and singular the Stock negro goods and chattels and farming utensils herein before granted bargained and sold or mentioned and intended so to be unto the said Joshua Gray his Executors administrators or assigns forever and to and for no other use intent or purpose whatsoever Provided always and these presents are upon this condition that if the said George W Gray his Executors or administrators shall and do well and truly pay or cause to be paid unto the said Joshua Gray his Executors administrators or assigns the full sum of one hundred and fifty seven dollars in the interest now due and accruing on or before the second day of June One thousand Eight hundred and forty Eight and shall also bear harmless and fully indemnify the said Joshua Gray for all loss he may sustain by reason of any securityship for him the said George W Gray for which the said Joshua is now responsible then and in such case these presents and every matter and thing herein contained shall cease and determine and be utterly void to all intents and purposes any thing herein Contained to the Contrary thereof in any wise notwithstanding and the said George W Gray doth hereby Covenant promise and agree to and with the said Joshua Gray that he will pay him the said sum of one hundred and fifty seven dollars with Interest from the 28th day of February 1842 on or before the 2nd day of June 1848 and that he will fully indemnify him against loss by reason of the securityships which the said Joshua is now under for him and the said George W Gray for himself his Executors and administrators all and singular the said property heretofore described and by these presents granted bargained and sold and every part thereof unto the said Joshua Gray his Executors administrators and assigns against him the said George W Gray his Executors and administrators and against all and every other person or persons shall and will warrant and defend by these presents In Witness whereof the said George W Gray hath hereto set his hand and affixed his seal the day herein before first written George W Gray (seal) (Signed) |
