211 singular the goods and household and kitchen furniture now in the possession of the said George McNeir at his residence in Church Street in City of Annapolis To have and To hold the aforesaid leasehold interest and all and singular the household & kitchen furniture herein before granted bargained and sold or mentioned or intended so to be unto the said Richard R Goodwin his executors administrators and assigns forever interest nevertheless for the uses intents and purposes herein after particularly set forth expressed limited and declared and for no other use intent or purpose whatsoever that is to say whereas Nicholas Brewer William Brewer Senr Doctr Dennis Claude William McNeir Richard R Goodwin Robert Welch of Ben William OHara and Washington G Tuck now stand liable to the President directors and Company of the Farmers Bank of maryland as endorsers for the said George McNeir for divers sums of money on sundry notes drawn by the said George McNeir and negotiated at the Farmers Bank of maryland which said notes it is intended shall be renewed from time to time and whereas also the said Richard R Goodwin and William McNeir stand liable to a certain John Gibson & Company of the City of Baltimore as endorsers for the said George McNeir on a note drawn by the said George McNeir & Son and endorsed by the said Richard R Goodwin William McNeir It is therefore hereby declared to be the meaning of these presents and of the parties thereto that all the premises herein and hereby bargained and sold or intended to be bargained and sold to the said Richard R Goodwin in manner aforesaid are to be held deemed and taken in trust and Confidence to raise by a sale of the same or any part thereof in such manner as the said Nicholas Brewer William Brewer Senr Doctr Dennis Claude William McNeir Robert Welch of Ben William OHara Washington G Tuck or a majority of them or the survivor or survivors of them shall think proper and in writing direct so much money as will be sufficient thereof or and the same money when raised to apply to the purpose of paying off satisfying and discharging all and singular the said debts together with all interest and Cost that may accrue thereon and in all respects to save harmless indemnify and reimburse the said Nicholas Brewer William Brewer Sen.r Dennis Claude William McNeir Richard R Goodwin Robert Welch of Ben William OHara and Washington G Tuck their heirs executors and administrators for and on account of their having become bound as aforesaid or for any monies that they may hereafter be compelled to advance for and on account of him the said George McNeir In Witness whereof the said George McNeir hath hereunto subscribed his name and affixed his seal the day and year first herein before written Signed Sealed and delivered in presence of the erasure and interlineation on the Geo McNeir (seal) second page being made Wm Glover At the foot of the aforegoing was thus written to wit State of Maryland Anne Arundel County to wit On this 22 day of October 1842 (personally) |
