162 and To hold all the wood aforesaid and every part and parcel thereof unto the said James L Sutton his Executors administrators and assigns to his and their own use and behoof Provided always and it is hereby declared to be the true intent and meaning of these presents and of the parties hereunto that if the said Benjamin Robinson do and shall well and truly pay or cause to be paid unto the said James L Sutton his Executors administrators or assigns the Sum of Four hundred and twelve dollars and fifty seven cents Current money at the time limited in the aforesaid promissory note for the payment of the same then and in that case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes any thing herein contained to the Contrary Notwithstanding and the said Benjamin Robinson and Harriet Robinson his wife for themselves their Executors and administrators do hereby Covenant promise and agree to and with the said James L Sutton his Executors administrators and assigns that they the said Benjamin and Harriet their Executors or administrators shall and will well and truly pay or cause to be paid unto the said James L Sutton his Executors administrators or assigns the said sum of Four hundred and twelve dollars and fifty seven cents Current Money aforesaid owing on the aforesaid promissory at the time therein limited for the payment thereof and also that if default shall be made in the payment of the said Sum of four hundred and twelve dollars and fifty seven Cents at the time herein limited for the payment of the same it shall and may be lawful to and for the said James L Sutton his Executors administrators or assigns and it is hereby declared to be the intent and meaning of these presents that he or they may and shall enter upon the aforesaid Tract or parcel of land and at his or their Cost and expense cut down and take from thence the number cords of wood that shall be Sufficient at a valuation of sixty cents for each and every Cord of wood to pay the said sum of money or such part thereof as may be then due and unpaid and also that until the aforesaid sum of money shall be fully satisfied and paid to the said James L Sutton his Executors administrators or assigns the said Benjamin and Harriet their heirs Executors administrators or assigns shall not cut down or remove from off the said Land any wood except such as they may occasionally require for piles In Witness whereof the said Benjamin and Harriet have hereunto subscribed their names and affixed their seals the day and year first herein written Signed sealed and delivered in B Robinson (seal) presence of Jesse Cloud John Walter H Robinson (seal) At the foot of the aforegoing was thus written to wit State of Maryland City of Baltimore Sc Be it known and it is hereby Certified that |
