153 and forty five dollars and twenty two cents payable to Chancey Brooks & Co or order twelve months after date and one dated on the same day and year aforesaid for the sum of one hundred and forty five dollars and twenty two cents payable to Chancey Brooks and C.o Or order Eighteen months after date and whereas the said John Sewell is likewise security for the said Passmore McCullough in a note to Fendel Griffin for the sum of two hundred dollars bearing date the of in the year Eighteen hundred and forty one and John Rice aforesaid is also security in and of the said Passmore McCullough to the said Fendel Griffin for the sum of two hundred dollars Current money bearing date the day of in the year Eighteen hundred and forty and to indemnify secure and save harmless his sureties aforesaid from any loss or damage whatever which they may sustain in case he the said Passmore McCullough shall fail to pay the aforesaid notes or obligations the aforesaid Passmore McCullough is willing to execute these presents Now this Indenture Witnesseth that the said Passmore McCullough for and in consideration of the premises and for and in consideration of the sum of one dollar to him in hand paid by the said Benjamin E Gantt Stephen Gambrill John Sewell and John Rice at or before the sealing and delivery of these presents the receipt whereof the said Passmore McCullough doth hereby acknowledge and thereof and therefrom doth acquit release exonerate and forever discharge the said Benjamin E Gantt Stephen Gambrill John Sewell and John Rice their heirs executors and administrators and every of them by these presents hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Benjamin E Gantt Stephen Gambrill John Sewell and John Rice their Executors administrators and assigns all and singular the goods furniture and household Stuff herein after particularly mentioned and expressed that is to say one negro man named Jack Brown aged fifty five one Gray horse one black horse one bay horse and one gray mare one yoke of oxen and ox cart two horse Carts one four wheel carriage and harness one carpet one sideboard one bureau two dozen chairs two beds and bedding two parlour looking glasses and five hundred cords of Cut wood on Prospect Plains in Anne Arundel County and two wood shantees on Prospect Plains to have and to hold all and singular the said Goods furniture household Stuff and property herein before granted bargained and sold or mentioned or intended so to be unto the said Benjamin E Gantt Stephen Gambrill John Sewell and John Rice their Executors administrators and assigns forever Provided always and these presents are upon this Condition that if the said Passmore McCullough his Executors or administrators shall and do well and truly pay or cause to be paid the aforesaid notes herein before described in which Benjamin E Gantt and Stephen Gambrill are sureties and the aforesaid Note herein before mentioned and described in which John Sewell is surety and also the aforesaid Note herein before named mentioned and described in which John Rice is surety and save harmless (from) |
