128 H Wood my Executors and administrators and against all and every person and persons whomsoever shall and will warrant and forever defend by these presents Provided Nevertheless that in case I the said George H Wood shall pay and satisfy to the said Richard Stallings or his Executors administrators or assigns the sum of one hundred & Thirty Dollars and seventy five cents Current money with Interest on the same on or before the 5th day of June 1842 then this bill of sale and every matter and thing therein expressed shall be void and of none effect it being the true Intent and meaning thereof that the said property is mortgaged by me to the said Rich.d Stallings for the payment of the money aforesaid In Witness whereof I the said George H Wood have hereunto set my hand and affixed my seal the third day of May 1841 Signed Sealed and delivered in the presence of George H Wood (seal) Lewis Sutton S.r John H Urquhart On the back of the aforegoing was thus written to wit State of Maryland Anne Arundel County to wit On this Third day of may 1841 Anno Domini before me one of the Justices of the peace in and for the State and County aforesaid appears George H Wood and acknowledges the foregoing Instrument of writing to be his act and deed according to the true intent and meaning thereof and the acts of assembly in such a case made and provided chd Witness my hand Lewis Sutton S.r 62 Recorded the 17th day of May 1841 Know all men by these presents that I Samuel Norman of Anne Arundel County and State of maryland for and in consideration of the sum of fifteen hundred dollars which Martha D Simmons has joined me in securing the payment of to Samuel H Whittington by mortgaging jointly with myself and her mother curtain Lands which will more fully and at large appear by reference to said mortgage executed this day and also in consideration of the Sum of one dollar in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said Martha D Simmons her heirs Executors administrators and assigns one Negro Girl named Matilda Adams about fourteen years of age and one Negro Boy named Jacob Adams about Eleven years of age the girl to serve untill twenty three years of age and the boy untill twenty six years of age to her and their only proper use and behoof Provided however and its expressly understood that in case the said Martha D Simmons shall not have to pay any part or parcel of said mortgage then this Instrument of writing to be null and void otherwise to (be) |
