103 State of Maryland Anne Arundel County to wit This Indenture made this 4th day of November in the year of our Lord 1840 Between Dennis H Battee of Anne Arundel County and state of maryland of the one part and Charity E Gosnell of the County and State aforesaid of the other part Witnesseth that whereas the said Dennis H Battee owes and stands Justly indebted to the said Charity C Gosnell in the sum of two hundred and fifty three dollars Current Money and to secure the payment thereof is willing to Execute these presents Now this Indenture witnesseth that the said Dennis H Battee for and in consideration of the premises and for and in Consideration of the sum of five dollars Current money to him in hand paid by the said Charity C Gosnell at or before the sealing and delivery of these presents the receipt whereof the said Dennis H Battee doth hereby acknowledge and thereof and therefrom doth acquit release exonerate and for ever discharge the said Charity C Gosnell her heirs Executors and administrators and every of them by these presents hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Charity C Gosnell her Executors administrators or assigns all and singular the property herein after named that is to say whereas whereas a certain Hester Gosnell of the County and State aforesaid by her last will and testament bearing date 8th day of December in the year of our Lord Eighteen hundred and thirty six and recorded in the Registers of Wills office in and for said County refference to which will more fully Show did by her act therein Constitute and appoint the said Dennis H Battee her son in law her sole trustee and did vest in said trustee the powers to act for the said John O Battee and the said Ann Caroline Battee And whereas for the use and benefit of said Children it is necessary to liquidate a certain mortgage now hanging over said estate and for their education &.c And for the payment of certain claims due from said Hester Gosnell to said Charity C Gosnell and for and in Consideration of the premise herein recited I bargain and sell to the said Charity C Gosnell her Executors administrators or assigns all and singular the within named property namely one negro boy named James and one negro boy named Samuel and all the stock and farming utensils attaching or in any wise appertaining thereto To have and To hold all and singular the said goods and personal Estate herein before granted bargained and sold or mentioned or intended so to be unto the said Charity C Gosnell her Executors administrators or assigns to the only proper use and behoof of the said Charity C Gosnell her Executors administrators and assigns for ever provided always and these presents are upon these conditions that if the said Dennis H Battee his Executors administrators or assigns shall and do well and truly pay or cause to be paid unto the said Charity C Gosnell her Executors administrators or assigns the full (Sum) |
