104 sum of two hundred and fifty three dollars current money with legal Interest for the same on or before the 4th of November in the year of Eighteen hundred and forty four then and in such case these presents and every matter and thing herein Contained shall cease determine and be utterly void to all intents and purposes any thin herein Contained to the Contrary thereof in any wise Notwithstanding And the Said Dennis H Battee for himself doth agree to pay unto the said Charity C Gosnell her Executors administrators or assigns the sum of two hundred and fifty three dollars with legal Interest thereon And the said Dennis H Battee for himself his Executors administrators or assigns all and Singular the said goods and personal Estate by these presents bargained and sold and every part thereof unto the said Charity C Gosnell her Executors administrators or assigns against him the Said Dennis H Battee his Executors administrators or assigns and against him and all and every other person and persons whatsoever Claiming shall and will warrant and forever defend by these presents and the said Charity C Gosnell for herself her heirs Executors administrators doth Covenant promise grant and agree to and with the said Dennis H Battee his Executors and administrators that ^she^ the said Charity C Gosnell her Executors administrators or assigns shall and will immediately upon the receipt of the said sum of two hundred and fifty three dollars Current Money of the State of Maryland with legal Interest as aforesaid at the day and time above limited for payment thereof deliver or cause to be delivered unto the said Dennis H Battee his Executors administrators or assigns all and singular the within named goods and personal estate aforesaid granted and which are now and at the time of executing these presents were received by the said Charity C Gosnell of and from the said Dennis H Battee in as good Case plight and Condition as the same and every of them are at this present time In Witness whereof we have severally affixed our names the day and year above written 4th Nov.r 1840 then personally appeared Dennis H Battee and Charity C Gosnell parties to the within instrument or mortgage and acknowledge it to be their act and deed for the purposes therein named Exd d d D H Battee chd Charity C Gosnell Acknowledged before Saml H Hamilton $1.07 9½ Recorded the 12th day of November 1840 This Indenture made this twenty first day of November in the year of our Lord |
