said William H. Duvall stands justly indebted to the said Nicholas R. Warfield in the sum of sixty dollars and the said Nicholas R. Warfield also being further bound and liable to pay as security & superceder divers debts and claims against the said William H. Duvall namely to samuel R. Gaither a promissory note dated the 17th day of January 1854 for forty two dollars with interest one judgment to Thomas Warren and son for forty dollars with interest from the 25.th April 1853 and one judgment to Dennis P. Gaither Executor of Perry Gaither for sixteen dollars with interest from the 18.th day of April 1854 and to secure the said sum of money to the said Nicholas R. Warfield owing as aforesaid and also to secure save and keep harmless the said Nicholas R. Warfield and his heirs from loss by reason of his said liabilities the said William H. Duvall has agreed to execute these presents. Now This Indenture witnesseth that for and in consideration of the said premises and also of the sum of one dollar current money to the said William H. Duvall by the said Nicholas R. Warfield in hand paid before the sealing and delivery of these presents the receipt of which is hereby acknowledged the said William H. Duvall has granted bargained and sold and by these presents doth grant bargain and sell unto the said Nicholas R. Warfield his heirs and assigns all and every of the articles hereinafter |
