one negro man name David Warner aged about forty one years to serve until the fourth day of April Eighteen hundred and sixty three when he is to be free and discharged from all service and servitude as will appear from by the bill of sale from William Burdett to said Waters executed on the 7th day of October 1838 and Recorded among the chattle Records of Carroll County in Liber J. B. B. No 4 folio 436 &c reference thereto being had will more fully appear. And Whereas on the 7th day of April 1859 the said Charles Waters filed in the Circuit Court for Carroll County his petition for an extention of the time of the said David Warner as such slave Whereupon the Circuit Court passed the following order To wit: "The petition in this case is dismissed. The court thinks that the negro is not made a free man by the bill of sale exhibited in this case that after his time of service expired with Waters Burdett can claim him as his slave and the negro could not resume his freedom upon the bill of sale. Now it is declared to be the true intent and meaning of this bill of sale that the said Charles Waters conveyes all his right title and interest claim and demand of the said David Warner as well under and by virtue of the bill of sale from Burdett to him as also any right title interest or claim that may accrue to him hereafter under and by virtue of the aforegoing order of the Circuit Court for Carroll County to David Burdett of Howard County aforesaid his heirs and assigns for ever. To have and to Hold the said David Warner ^free^ clear and discharged from all claims whatever of him the said Charles R Waters his heirs and assigns forever. In Witness whereof the said Charles R Waters and David Burdett have hereunto set their hands and seals this seventeenth day of May 1859 Test J Henry Hopper C R Waters (seal) W A.
