as William Woodward and Company of the other part Whereas the said firm of William Woodward and Company have accepted three drafts of the said James Sykes drawn for his accommodation dated on the fifth day of June 1856 and payable as follows one for four hundred and sixteen dollars payable eight months after date one for four hundred and twenty four dollars payable twelve months after date and the other of four hundred and thirty six dollars payable eighteen months after date which said drafts were negotiated by said James Sykes to pay for the property herein after mortgaged. And whereas the said parties in consideration of such acceptance agreed that these presents should be executed the execution hereof being a condition precedent to such acceptance. Now these presents witness that the said James Sykes in consideration of the premises and of one dollar to him paid hath bargained sold and delivered and doth hereby bargain sell and deliver unto the said William Woodward and William H. Baldwin their executors administrators and assigns one pair new self acting mules of eight hundred Spindles now in the factory at Sykesville occupied by said James Sykes To Have and To Hold the same unto the said William Woodward and William H. Baldwin Junior their executors administrators and assigns forever. Provided always and these presents are upon this condition that if the said James Sykes does and shall well and truly pay take up and return to said William Woodward and Company the three drafts above recited when and as the same fall due respectively and do and shall in the meantime keep the said mules insured to the amount of twelve hundred dollars the name of said William Woodward and Company then |
