(ii) Are not subject to the provisions of Title 8, Subtitle 4 of this article
on the disposition of highway user revenues.

(e) (1) In addition to any other fee or penalty provided by law, an owner of a
vehicle who is denied registration of the vehicle under the provisions of this section shall
pay a fee [of $5] ESTABLISHED BY THE ADMINISTRATION before renewal of the
registration of the vehicle.
(2) The fee described under paragraph (1) of this subsection shall be
retained by the Administration and may not be credited to the Gasoline and Motor
Vehicle Revenue Account for distribution under § 8-403 or § 8-404 of this article.
SECTION 2. AND BE IT FURTHER ENACTED, That until the Motor Vehicle
Administration sets the level of any miscellaneous fee as authorized under this Act, the
amount of the fee shall be the amount in effect on June 30, 1991.
SECTION 3. AND BE IT FURTHER ENACTED, That the Motor Vehicle
Administration shall initially set the levels of miscellaneous fees as authorized under this
Act so that at a minimum for Fiscal Year 1992 the additional revenues generated together
with the proceeds of any increased indebtedness of the Department of Transportation
supported by those additional revenues will be sufficient to enable the Department to
meet in full any federal fund matching requirement and avoid the loss during the 1991
federal fiscal year of the State's share of federal highway obligation authority, bridge
discretionary funds, and interstate discretionary funds that have been allocated or are
available for allocation to the State.
SECTION 4. AND BE IT FURTHER ENACTED, That for Fiscal Year 1992, the
additional revenues generated as a result of this Act or under the authority of this Act
and the proceeds of any increased indebtedness of the Department of Transportation
supported by those additional revenues shall only be used by the Department as follows:
(1) first to meet in full any federal fund matching requirement and avoid the
loss during the 1991 federal fiscal year of the State's share of federal highway obligation
authority, bridge discretionary funds, and interstate discretionary funds that have been
allocated or are available for allocation to the State; and
(2) the balance not required under paragraph (1) of this section may be
used only to fund other needed highway, bridge, aviation, port, railroad, or transit
projects, except for light rail projects.
SECTION 5. AND BE IT FURTHER ENACTED, That notwithstanding the time
limitations under § 12-120(c) of the Transportation Article, on or after July 1, 1991 the
Motor Vehicle Administration by regulation may alter miscellaneous fees as authorized
under this Act effective for Fiscal Year 1992.
SECTION 6. AND BE IT FURTHER ENACTED, That notwithstanding the
provision of § 16-115 of the Transportation Article providing for the expiration of a
driver's license in the fifth year following the issuance of the license, the Motor Vehicle
