273 the said Goods, Wares and Merchandize & furniture unto the said Z. Tarman his executors administrators and assigns against me the said John B. Regnier my Executors and administrators and against all and every other person or persons whatsoever shall and will warrant and forever defend by these presents. Provided Nevertheless and it is the true intent and meaning of these presents and of the said parties hereto that in Case I the said Robert B. Regnier my executors or administrators well and truly pay and satisfy to the said Z. Tarman my executors administrators or assigns the said sum of Three Hundred & ninety two dollars and twenty cents on or before the twenty sixth day of April Eighteen hundred and fifty seven with interest for the same in the mean time then the Bill of Sale and every matter and thing herein expressed shall be null and void it being the true intent and meaning hereof that the said Goods Wares and Merchandize & furniture are mortgaged by me to the said Z. Tarman to secure to the said Z. Tarman his Executors administrators or assigns the payment of the said sum of Three Hundred & ninety two Dollars & twenty Cents. In Witness Whereof I have hereunto set my hand and seal this Seventeenth day of April eighteen hundred and fifty seven Signed sealed and delivered in the presence of J. B. Regnier (seal) A. H. Penington State of Maryland City of Baltimore sct Be it remembered that on this Seventeenth day of April 1857 before the subscriber a Justice of the Peace for said City appeared John B. Regnier and acknowledged the foregoing instrument of writing to be his act and deed according to the true intent and meaning thereof. And now at the same time before me personally appeared also Z. Tarman the within named Mortgagee and made oath in due form of law that the consideration set forth in the within mortgage is true and bona fide as therein set forth. In Testimony Whereof I have hereunto subscribed my name on the day and year aforesaid A. C. Penington J. P. State of Maryland Baltimore City sct I hereby Certify that Augustine H. Penington Esquire before whom the annexed acknowledgment & affidavit were made and who has thereto subscribed his name was at the time of so doing a Justice of the Peace of the State of Maryland in and for the City of Baltimore duly Commissioned and sworn.
