267 Simms aged about twelve years negro Girl Ellen Simms aged about eight years negro Girl Nanna aged about four years & negro child Mary Simms aged about eighteen months all the above negroes are slaves for life and are part of the same negroes that Benjamin B. Harrison Conveyed to Reuben Tall by Bill of Sale bearing date the 26th day of January 1850 and recorded among the Chattel record Books for Dorchester County reference being had thereto will more fully and at large appear. Provided, that if I the said Benjamin B. Harrison shall pay to the said David W Tyler the said sum of Five Hundred and seventy five Dollars with the interest thereon on or before the thirteenth day of April next then these presents shall be void. Provided also and it is hereby agreed between the parties to these presents that if default shall be made by the said Benjamin B. Harrison his Executors or administrators in payment of the said sum of Five Hundred and seventy five Dollars or any part thereof and interest thereon at the time specified in these presents then and in such case it shall be lawful for the said David W. Tyler to sell all the property specified in these presents or so much thereof as may be necessary to pay said sum of Five Hundred and seventy five Dollars and interest thereon and expenses of said sale in the following manner the said David W. Tyler shall sell the said above named negroes at Public Sale at the Court House door at Cambridge giving ten days notice in one of the newspapers printed in Cambridge and the proceeds arising from said sale to be applied first to the payment of the expenses of said sale then to the payment of the sum of Five Hundred and seventy five Dollars with the interest thereon as specified in these presents or so much thereof as may be due at the time of such sale and the surplus if any to ^by^ be paid over to the said Benjamin B. Harrison his Executors administrators or assigns. Witness my hand and seal this twenty third day of March Eighteen Hundred and fifty seven. Test Wm R Tall B. B. Harrison (seal) Josiah Jump State of Maryland Dorchester County to wit: I hereby Certify that on this twenty third day of March Eighteen Hundred and fifty seven Personally appeared before the subscriber a Justice of the Peace for Dorchester County aforesaid, Benjamin B. Harrison and acknowledged the foregoing Bill of sale to be his act. At the same time and place aforesaid personally appeared before me David W. Tyler Mortgagee within named and made oath on the Holy Evangely of Almighty God, that the Consideration set forth in this Mortgage is true & bona fide as therein set forth Acknowledged & sworn before Wm R. Scott of Dorchester County Maryland in the sum of Six Hundred Dollars with interest from January 1 last past in Consideration thereof do hereby bargain and sell to the said John A Scott the following property now in the farm where I now live purchased of said Scott Three yoke of Steers and one odd steer two Cows & one Calf two steer and one bull yearling seven old sheep and five lambs two sows & ten pigs two Shoats three ox Carts one waggon & gear one |
