236 John W. Brohawn Be it remembered and it is hereby certified that the following Mortgage Bill of Sale & Thomas Wallace was received and recorded on the 18th day of August Anno Domini 1856 to wit: √ from xd This Mortgage made this twenty ninth day of July in the year of our Lord eighteen Benjamin McWilliams hundred & fifty six Witnesseth Whereas John W. Brohawn and Thomas Wallace have this day entered into a Recognizance before the Circuit Court of Dorchester County in the penalty of One Hundred Dollars each for the appearance of Benjamin McWilliams before said Court at the November Term to answer a charge or Indictment before said Court pending for stealing a Certain lot of Bacon the property of one William Briley and for his continuing so to appear from day to day until he is legally discharged by said Court. Now this instrument Witnesseth that for and Consideration of the premises & the sum of Five Dollars also due the said Brohawn & Wallace for expenses incurred at the instance of the said McWilliams the said Benjamin McWilliams & Sarah Ann McWilliams his Wife do grant unto the said John W. Brohawn and Thomas Wallace all those several tracts of Land Called "Buck Hill" & "Phillips Regulation" situated lying & being in the County aforesaid and in the Election District No 1 & embracing the farm where the said McWilliams & wife now reside Containing about sixty acres of land more or less also one yoke of oxen 2 Cows one Calf 9 head of Hogs and four Beds. Provided that if the said Benjamin McWilliams shall appear before the Circuit Court of Dorchester County to be held in Cambridge on the second Monday of November next to answer the charge or Indictment aforesaid & shall so continue to appear from day to day until he shall be legally discharged by the said Court & in all respects save harmless & from all loss whatsoever the said John W. Brohawn & the said Thomas Wallace by reason of having entered into said Recognizance for the said McWilliams then this Mortgage to be void Witness our hands & seals Test William Russell his Wm W Robinson Benjamin x McWilliams (seal) mark his Sarah Ann x McWilliams (seal) mark State of Maryland Dorchester County sct: I hereby certify that on this seventh day of August in the year Eighteen hundred & fifty six before the subscriber a Justice of the Peace of the State of Maryland in & for said County Personally appeared Benjamin McWilliams and at the same time appeared ^also^ Thomas Wallace and made oath that the Consideration therein mentioned is true & bona fide as therein set forth Wm W Robinson J. P. David W Tyler Be it remembered and it is hereby Certified that the following Mortgage √ From xd Bill of Sale was received and recorded on the 27th day of August 1856 to wit Benjamin B. Harrison This Indenture made this sixteenth day of August in the year of our Lord one thousand eight hundred and fifty six between Benjamin B Harrison M. D. of Dorchester County in the State of Maryland of the one part and David W Tyler of said County and State of the other part. Whereas the said Benjamin B. Harrison by his Bill Obligatory duly executed bearing date on the sixteenth day of August one thousand eight hundred and fifty six is indebted unto the said David W Tyler his Executors administrators and assigns in the just and full sum of Four Hundred and forty six Dollars with legal interest thereon which said Bill Obligatory is payable six months after the date thereof as by the same will more fully appear Now this Indenture Witnesseth that the said Benjamin B. Harrison in Consideration of the said debt or sum of Four hundred and forty six Dollars owing to the said David W Tyler as aforesaid and for the better securing the payment thereof with interest to the said David W. Tyler his Executors administrators or assigns according to the tenner and effect of the said Bill Obligatory and also in Consideration of the |
