(2) THE SECRETARY MAY NOT UNREASONABLY WITHHOLD EXPRESS
PERMISSION TO ENGAGE IN OTHER EMPLOYMENT.
(3) IF THE SECRETARY GRANTS PERMISSION TO ENGAGE IN OTHER
EMPLOYMENT, THE EMPLOYEE SHALL DISCLOSE TO THE SECRETARY THE SOURCE
AND AMOUNT OF ALL INCOME EARNED FROM THAT OTHER EMPLOYMENT.
(D) STAFF — OTHER UNITS.
(1) THE APPOINTMENT OR REMOVAL OF STAFF OF A UNIT IN THE
DEPARTMENT IS SUBJECT TO THE APPROVAL OF THE SECRETARY.
(2) THE SECRETARY MAY DELEGATE THE POWER OF APPROVAL
ESTABLISHED UNDER PARAGRAPH (1) OF THIS SUBSECTION TO THE HEAD OF THE
UNIT.
(E) CODE OF CONDUCT.
THE DEPARTMENT SHALL:
(1) ADOPT A CODE OF CONDUCT FOR STAFF OF THE DEPARTMENT; AND
(2) REQUIRE EACH PRIVATE AGENCY UNDER CONTRACT WITH THE
DEPARTMENT TO ADOPT A CODE OF CONDUCT FOR ITS STAFF THAT IS IN
SUBSTANTIAL COMPLIANCE WITH THE CODE OF CONDUCT FOR STAFF OF THE
DEPARTMENT.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 83C, § 2-103(d).
In subsections (b)(1)(ii) and (c)(1) of this section, the references to an
"employee" are substituted for the former references to "personnel" for
consistency with terminology used in §§ 9-208 and 9-209 of this subtitle.
In subsection (b)(3) of this section, the reference to the requirement to
appoint and remove staff in accordance with the State Personnel and
Pensions Article "[u]nless otherwise provided by law" is substituted for the
former reference to "[e]xcept as provided in paragraph (4) of this
subsection or otherwise by law" for brevity.
In subsection (d)(2) of this section, the former phrase "[a]s to any unit in
the Department" is deleted as surplusage.

9-208. EMPLOYEES — IN GENERAL.
IN COOPERATION WITH THE SECRETARY OF BUDGET AND MANAGEMENT, THE
SECRETARY SHALL:
(1) SET MINIMUM SALARIES, QUALIFICATIONS, AND STANDARDS OF
TRAINING AND EXPERIENCE FOR THE POSITIONS IN THE DEPARTMENT; AND
