2003 LAWS OF MARYLAND

Subsection (b)(1)(ii) of this section is new language derived without
substantive change from former Art. 27, § 443(b)(2), as it related to the
annual renewal fee of $25.

Subsection (b)(1)(iii) of this section is standard language added to state
expressly that which only was implied in the former law, i.e., renewal
applications may be made only on the form that the Secretary provides.

Subsection (b)(2) of this section is new language derived without
substantive change from the second clause of the first sentence of former
Art. 27, § 443(b)(3).

In subsection (a) of this section, the reference to the expiration of a dealer's
license "on the first June 30 after its effective date" is substituted for the
former reference to "the 30th day of June of each year" to conform to the
practice of the Secretary and to similar provisions governing other
State-regulated businesses. See, e.g., BR §§ 12-207 and 16-207.

Also in subsection (a) of this section, the former reference to a dealer's
license "required by subsection (a) above" is deleted as surplusage.

5-112. NONTRANSFERABILITY OF DEALER'S LICENSE; NEW PLACE OF BUSINESS.

(A)     NONTRANSFERABILITY OF DEALER'S LICENSE.
A DEALER'S LICENSE IS NOT TRANSFERABLE.

(B)     NOTICE TO SECRETARY OF NEW PLACE OF BUSINESS.

BEFORE MOVING A PLACE OF BUSINESS, A LICENSEE SHALL INFORM THE
SECRETARY AND SURRENDER THE DEALER'S LICENSE.

(C)     NEW DEALER'S LICENSE FOR NEW PLACE OF BUSINESS.

IF A CAUSE TO REVOKE THE DEALER'S LICENSE DOES NOT EXIST, THE
SECRETARY SHALL ISSUE A NEW DEALER'S LICENSE WITHOUT CHARGE COVERING
THE NEW PLACE OF BUSINESS FOR THE REST OF THE TERM OF THE SURRENDERED
DEALER'S LICENSE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 443(b)(3), except for the second clause of the
first sentence.

In subsection (c) of this section, the reference to "the rest of the term" is
substituted for the former reference to "the duration of the unexpired
term" for brevity.
