Also in subsection (d)(1) of this section, the reference to the circuit court of
the county where the applicant's place of business is to be "located" is
substituted for the former reference to the circuit court of the county where
the applicant's place of business is to be "conducted" for clarity.

In subsection (d)(4) of this section, the former reference to a decision
reached by the circuit court "in accordance with this subsection" is deleted
as surplusage.

The Public Safety Article Review Committee notes, for consideration by the
General Assembly, that subsection (a) of this section requires the Secretary
to disapprove an application for a dealer's license if the Secretary receives
specified notification that the applicant suffers from a mental disorder.
Subsection (d) of this section, however, does not include a finding that the
applicant suffers from a mental disorder as a ground on the basis of which
the court may affirm or reverse the disapproval of an application by the
Secretary. The Committee notes this inconsistency for consideration by the
General Assembly.

5-111. TERM OF DEALER'S LICENSE.

(A)     IN GENERAL.

UNLESS A DEALER'S LICENSE IS RENEWED FOR A 1-YEAR TERM AS PROVIDED
IN THIS SECTION, A DEALER'S LICENSE EXPIRES ON THE FIRST JUNE 30 AFTER ITS
EFFECTIVE DATE.

(B)     APPLICATIONS FOR RENEWAL.

(1)      BEFORE A DEALER'S LICENSE EXPIRES, THE LICENSEE
PERIODICALLY MAY RENEW IT FOR AN ADDITIONAL 1-YEAR TERM, IF THE LICENSEE:

(I)      IS OTHERWISE ENTITLED TO BE LICENSED;

(II)     PAYS TO THE SECRETARY A RENEWAL FEE OF $25, PAYABLE TO
THE COMPTROLLER; AND

(III)    SUBMITS TO THE SECRETARY A RENEWAL APPLICATION ON
THE FORM THAT THE SECRETARY PROVIDES.

(2)     A REFUND OR PRORATION OF THE RENEWAL FEE IS PROHIBITED.

REVISOR'S NOTE: Subsection (a) of this section is new language derived
without substantive change from former Art. 27, § 443(b)(1).

Subsection (b)(1)(i) of this section is new language added for clarity.
