[14-8.] 10-204. Petition for improvements. (A) Before the powers granted by this section to the County Commissioners
shall be exercised there shall first be: (1) [the] THE petition of property owners as [hereinbefore] provided IN
THIS SECTION requesting improvements; [public] (2) A PUBLIC hearing [upon said] ON THE petition after ten days' notice
either in a newspaper regularly published in Carroll County or by the delivery of a
complete copy of [said] THE petition by registered mail or personal delivery to each of
the affected abutting property owners[,]; AND (3) [approval] APPROVAL of [said] THE petition by the County
Commissioners[; and the passage of]. (B) SUBJECT TO SUBSECTION (A) OF THIS SECTION, THE COUNTY
COMMISSIONERS SHALL PASS an appropriate ordinance, pursuant to the authority of
this section, setting forth the improvements being constructed, the property owners
affected, and all material terms of the annual benefit assessments levied to pay the
cost of [said] THE improvements, or any reasonable portion [thereof], as determined
by the County Commissioners; provided that no assessment shall exceed the total
assessed value of the property, excluding any improvements [thereon], after giving
effect to benefits accruing [thereto] from the improvement for which assessed. [14-9.] 10-205. Appeals. Any interested person feeling aggrieved by the levying of any benefit
assessment under this [subheading] SUBTITLE shall have the right to appeal to the
Circuit Court for Carroll County within thirty days after the final adoption of the
ordinance by the County Commissioners, and [such] THE court, sitting without a
jury, is authorized to hear and determine whether the county commissioners acted
[pursuant to] UNDER the authority [granted herein] UNDER THIS SUBTITLE and
whether the benefit assessments levied [pursuant to] UNDER the provisions of this
[subheading] SUBTITLE are imposed according to law. [14-10.] 10-206. Authority is additional. The authority extended to the County Commissioners by this [section]
SUBTITLE shall be in addition to, but not in substitution of, the powers [heretofore)
vested in [them] THE COUNTY COMMISSIONERS for the improvement of roads in
Carroll County. [Other Road Laws] SUBTITLE 3. OTHER ROAD LAWS. [14-11,] 10-301. Titles and plats. If the County Commissioners acquire title to any plots or areas of land at the
time of constructing a new road or widening or relocating an existing road, at the time
