2000 LAWS OF MARYLAND
SUBSTANTIALLY EQUIVALENT TO THIS TITLE, THE DIRECTOR MAY EXEMPT HOME
BUILDERS ENGAGED IN BUILDING NEW HOMES IN THAT COUNTY ONLY FROM THE
REQUIREMENTS OF THIS TITLE.
SUBTITLE 8 7. SHORT TITLE. 4.5-801. 4.5-701. THIS TITLE MAY BE CITED AS THE MARYLAND HOME BUILDER REGISTRATION ACT. Article - Real Property 14-117. (J) A CONTRACT FOR THE INITIAL SALE OF IMPROVED NEW RESIDENTIAL
REAL PROPERTY TO A MEMBER OF THE PUBLIC WHO INTENDS TO OCCUPY OR RENT
THE PROPERTY FOR RESIDENTIAL PURPOSES SHALL CLEARLY
AND CONSPICUOUSLY
INCLUDE
: (1) THE HOME BUILDER REGISTRATION NUMBER OF THE HOME BUILDER; (2) A STATEMENT THAT THE NEW HOME WILL BE OR HAS BEEN
CONSTRUCTED ACCORDING TO ALL APPLICABLE BUILDING CODES AND

PERFORMANCE STANDARDS AND GUIDELINES IN EFFECT AT THE TIME OF THE
CONSTRUCTION OF THE NEW HOME;
(3) REFERENCES TO ALL APPLICABLE PERFORMANCE STANDARDS AND
GUIDELINES WITH WHICH THE REGISTRANT WILL COMPLY; AND (4) A STATEMENT OF THE PURCHASER'S RIGHT TO RECEIVE A
CONSUMER INFORMATION PAMPHLET.
(J) (1) THIS SUBSECTION APPLIES TO BALTIMORE CITY AND ALL OTHER
COUNTIES EXCEPT MONTGOMERY COUNTY. (2) A CONTRACT FOR THE INITIAL SALE OF A NEW HOME, AS DEFINED IN
THIS SUBTITLE, SHALL INCLUDE THE FOLLOWING: (I) THE BUILDER REGISTRATION NUMBER OF THE SELLER OF THE NEW HOME; (II) A PROVISION STATING THAT THE NEW HOME SHALL BE
CONSTRUCTED IN ACCORDANCE WITH ALL APPLICABLE BUILDING CODES IN EFFECT
AT THE TIME OF THE CONSTRUCTION OF THE NEW HOME; (III) A PROVISION REFERENCING ALL PERFORMANCE STANDARDS
OR GUIDELINES: 1. THAT THE SELLER SHALL COMPLY WITH IN THE
CONSTRUCTION OF THE NEW HOME; AND
