(B) A COUNTY OR MUNICIPAL CORPORATION SHALL NOTIFY THE DIRECTOR
OF EACH REGISTRANT WHO FAILS TO CORRECT A VIOLATION OF THE APPLICABLE
LOCAL OR STATE BUILDING CODE WITHIN A REASONABLE TIME AFTER THE
REGISTRANT RECEIVES NOTICE OF THE VIOLATION. 4.5-704. 4.5-603. A REGISTRANT SHALL INCLUDE IN ANY CONTRACT FOR THE INITIAL SALE OF A
NEW HOME THE INFORMATION REQUIRED UNDER § 14-117(J) OF THE REAL
PROPERTY ARTICLE. 4.5-705. 4.5-604. A HOME BUILDER WHO INSTALLS AN INDUSTRIALIZED BUILDING INTENDED
FOR RESIDENTIAL USE OR A MOBILE HOME IS RESPONSIBLE TO THE OWNER FOR
CORRECTING ANY DEFECTS IN ANY COMPONENT INCORPORATED INTO THE NEW
HOME EXCEPT FOR THOSE INDUSTRIALIZED BUILDINGS OR MOBILE HOMES THAT
ARE THE RESPONSIBILITY OF THE MANUFACTURER OF THE INDUSTRIALIZED
BUILDING AND MOBILE HOME PURSUANT TO ARTICLE 83B, TITLE 6, SUBTITLE 2 OF
THE CODE. 1.5 706. 4.5-605. A CONTRACT FOR THE PERFORMANCE OF ANY ACT FOR WHICH A HOME
BUILDER REGISTRATION NUMBER IS REQUIRED IS NOT ENFORCEABLE UNLESS THE
HOME BUILDER WAS REGISTERED AT THE TIME THAT THE CONTRACT WAS SIGNED
BY THE OWNER 4.5-707. (A) SUBJECT TO SUBSECTION (B) OF THIS SECTION, IN ANY RESOLUTION OF A
COMPLAINT OR CLAIM AGAINST A REGISTRANT, THE PERFORMANCE STANDARDS
AND GUIDELINES APPLICABLE WILL BE THOSE REFERENCED IN THE UNDERLYING
PURCHA
SE CONTRACT, AS REQUIRED UNDER § 14-117(J) OF THE REAL PROPERTY
ARTICLE.
(B) A REGISTRANT SHALL COMPLY WITH: (1) ANY EFFECTIVE PERFORMANCE CODES, STANDARDS, GUIDELINES,
OR REGULATIONS ADOPTED BY A GOVERNMENTAL UNIT WITH JURISDICTION OVER
THE REGISTRANT OR THE NEW HOME; AND
(2) (I) THE CURRENT PERFORMANCE STANDARDS OR GUIDELINES
PUBLISHED BY THE NATIONAL ASSOCIATION OF HOME BUILDERS; OR
(II) PERFORMANCE STANDARDS OR GUIDELINES ADOPTED BY THE
REGISTRANT THAT ARE EQUIVALENT TO OR MORE
STRINGENT THAN THE
PERFORMANCE STANDARDS OR GUIDELINE
S PUBLISHED BY THE NATIONAL
ASSOCIATION OF HOME BUILDERS.
4.5-708. BASED ON A DETERMINATION THAT A COUNTY HAS A LICENSING OR
REGISTRATION SCHEME FOR HOME BUILDERS THAT IS FULLY OPERATIONAL AND
