(iii) Any entity that receives funds under the Local Public Health,
Counter marketing. Statewide Public Health, and Surveillance and Evaluation
Components may use a maximum of 7% of the funds for administrative costs.
(iv) The department may shift a maximum of 10% of the allocation
for each component of the Tobacco Use Prevention and Cessation Program to another
component of the Tobacco Use Prevention and Cessation Program, with the exception of
the Administrative Component, provided that the department must report the shift of
funds to the budget committees within 60 days.
(v) Under the Local Public Health Component, the funding shall be
allocated to the following activities in the proportions indicated:
15% Tobacco Cessation
45% Reduction of Tobacco Use
30% Reduction of Tobacco Use Among Minors
10% Enforcement
The local health officer may shift a maximum of 10% of the allocation for each
activity in the Local Public Health Component to another activity in the Local Public
Health Component. The local health officer may request a waiver from the secretary to
shift more than 10% of the allocation for one activity to another activity.
Administrative costs shall not exceed 7% of the total allocation for all activities under
the Local Public Health Component.
(vi) The department shall submit to the budget committees a revised
Managing for Results Plan for the Tobacco Use Prevention and Cessation Program
that includes short term goals for fiscal 2001. 2002. and 2003. This revised plan shall
be submitted by July 1, 2000. The short-term goals will allow the General Assembly to
evaluate the department's progress in implementing the Tobacco Use Prevention, and
Cessation Program.
(vii) The department may not award any funds to an outside entity
under the Surveillance and Evaluation Component before conducting a competitive
bid process.
(b) $32,300,000 of this amount shall be contingent on enactment of HB
1425 and may be used only for the Cancer and Tobacco Related Diseases Prevention,
Identification, and Treatment Program, established under HB 1425 as provided in this
paragraph.
(i) Funds for the Cancer and Tobacco Related Diseases Prevention.
Identification, and Treatment Program shall be allocated among program components
as listed below and may not exceed the amounts indicated for each component:
Local Public Health 7,900,000
Targeted Hospital Capacity 2,000,000
Statewide Academic Health Centers
-Johns Hopkins Institutions 2,250,000
