appropriated to program MK02.02. Addictions Treatment Services, may not be
expend
ed until the department submits a detailed report on the proposed use of the
funds. The department shall consult with the General Assembly on identifying the
greatest treatment needs and determining priorities. The report shall include funding
allocation, number of treatment slots, and a Managing for Results Plan. The report

shall be submitted by October 1, 2000. The budget committees shall have 45 days to
review and comment. The department shall also submit a report by June 30, 2001 on
the progress that has been made toward meeting the goals established in the
departments initial report.
(3) In the Board of Public Works Interagency Committee for Public School
Construction, $2,000,000 in Cigarette Restitution Funds appropriated to program
DE03.02, School Facilities Program, for the purpose of providing in classroom
telephones, may not be expended for that purpose. Authorization is hereby granted to
transfer these funds to program MQ01.03. Medical Care Provider Reimbursements, to
cover deficiencies in that program. If these funds are not transferred as authorized,
they may not be expended and shall revert to the Cigarette Restitution Fund at the
end of the fiscal year.
SECTION 42. AND BE IT FURTHER ENACTED, That in addition to any
requirem
ents imposed under Section 1 of this Act, the amounts appropriated from the
Cigarette Restitution Fund in this budget shall be restricted as provided in this section
:
(1) In the Community and Public Health Administration of the Department of
Health and M
ental Hygiene. $71.600.000 in Cigarette Restitution Funds appropriated
to program MF02
.06, Prevention and Disease Control, is restricted as follows:
(a) $22,200,000 of this amount shall be contingent on enactment of HB
1425 and may be used only for the Tobacco Use Prevention and Cessation Program
establish
ed under HB 1426 as provided in this paragraph.
(i) Funds for the Tobacco Use Prevention and Cessation Program
shall be allocated among program components as listed below, and may not exceed the
amounts indicated for each component:
Local Public Health 10,500,000 Countermarketing 7,500,000 Statewide Public Health 1,100,000 Surveillance and Evaluation 2,300,000 Administrative 800,000 (ii) Funds allocated to the Administrative Component shall be used
to fund all of the administrative costs in the department related to developing,
impl
ementing, and managing all components of the Tobacco Use Prevention and
Ces
sation Program. The department may not use any funds from the Local Public
Health, Countermarketing, Statewide Public Health, and Surveillance and
Evaluation Components for administrative purposes.
