Ch. 743

A SPECIAL APPOINTMENT IN the State Personnel Management System, and shall serve
at the pleasure of the Commission, perform such administrative functions as the
Commission shall direct, and receive a salary as provided in the budget.

4-503.

(a)     The Commission shall appoint the staff necessary to perform its duties.
However, the activities of the staff may not duplicate or conflict with the functions and
services of the Division of Parole and Probation. Except as otherwise provided by law, the
staff shall be subject to the provisions OF TITLE 6, SUBTITLE 4 of the State Personnel and
Pensions Article [that govern classified service employees].

(f) Beginning January 1, 1992, the creation and filling of all [classified service]
positions shall be in accordance with the provisions OF TITLE 6, SUBTITLE 4 of the State
Personnel and Pensions Article [that govern classified service employees].

6-103.

(b)     (2) All staff assistants in the Secretary's office in charge of particular areas
of responsibility and all professional consultants shall be in the [ unclassified service of]
EXECUTIVE SERVICE, MANAGEMENT SERVICE, OR SPECIAL APPOINTMENTS IN the
State Personnel Management System and shall serve at the pleasure of the Secretary.

(3) Except as otherwise provided by law, all other employees of the
Secretary's office shall be appointed and removed by the Secretary in accordance with the
provisions OF TITLE 6, SUBTITLE 4 of the State Personnel and Pensions Article [that
govern classified service employees].

6-203.

(c)     (2) (i) Except as provided in subparagraph (ii) of this paragraph or
otherwise by law, the employees of the Administration shall be subject to the provisions
OF TITLE 6. SUBTITLE 4 of the State Personnel and Pensions Article [that govern
classified service employees].

(ii) The Director and the deputy director are in the [unclassified]
EXECUTIVE SERVICE OR MANAGEMENT service of the State Personnel Management
System.

(3) Any employee of the Administration who is eligible for transfer to the
[classified service] STATE PERSONNEL MANAGEMENT SYSTEM and who has held this
position for at least six (6) months, shall be so transferred without further probation,
examination, or qualification. An employee transferred to the [classified service] STATE
PERSONNEL MANAGEMENT SYSTEM pursuant to this subsection shall be transferred in
the respective job classification under which the employee is employed at the time of
transfer and shall not receive any diminution in compensation and/or respective amounts
of accumulated leave or sick leave, solely as a result of this transfer.
