Ch. 743                                    1997 LAWS OF MARYLAND

(i) The employees shall be in the [classified] SKILLED SERVICE OR
PROFESSIONAL service [of], WITH THE EXCEPTION OF SPECIAL APPOINTMENTS, IN
the State Personnel Management System; and

(ii) The board may appoint and remove the employees in accordance
with the provisions of the State Personnel and Pensions Article [that govern classified
service employees].

Article 38A - Fires and Investigations

7.

(a)     (2) (ii) The Fire Marshal is in the [unclassified] EXECUTIVE service of
the State Personnel Management System and can be removed by the Secretary of Public
Safety and Correctional Services, at any time, for neglect of duty or other conduct
unbecoming the office. The Commission may recommend to the Secretary the removal of
the Fire Marshal for cause. Prior to removal, the Fire Marshal shall be given timely notice
by the Secretary with a statement of the charges and an opportunity in person or by
counsel for a public hearing thereon.

Article 41 - Governor - Executive and Administrative Departments

(b)     (2) All staff assistants in the Secretary's office in charge of particular areas
of responsibility and all professional consultants shall be in the [unclassified service of]
EXECUTIVE SERVICE, MANAGEMENT SERVICE, OR SPECIAL APPOINTMENTS IN the
State Personnel Management System and shall serve at the pleasure of the Secretary.

(3) Except as otherwise provided by law, all other employees of the
Secretary's office shall be appointed and removed by the Secretary in accordance with the
provisions of the State Personnel and Pensions Article [that govern classified service
employees] .

(e) Subject to the authority of the Secretary of Public Safety and Correctional
Services, the Commission is vested with the following powers, authority, responsibilities,
and duties:

(7) To appoint, with the approval of the Secretary of Public Safety and
Correctional Services:

(i) An Executive Director who shall be [in the unclassified service of]
A SPECIAL APPOINTMENT IN the State Personnel Management System and shall serve at
the pleasure of the Commission, perform general administrative functions, and receive
the compensation set by the Commission; and

(d) The Commission:

(9) Shall appoint, with approval of the Secretary of Public Safety and
Correctional Services, an Executive Director who shall be [in the unclassified service of]
