(c) (2) Except as otherwise provided by law, the employees of the program shall
be subject to the provisions of the State Personnel and Pensions Article; [that govern
classified service employees].

(3) Any employee of the Office who is eligible for transfer to the [classified

service] STATE PERSONNEL MANAGEMENT SYSTEM and who has held this position for

at least 6 months shall be so transferred without further probation, examination, or

qualification. An employee transferred to the [classified service] STATE PERSONNEL

MANAGEMENT SYSTEM pursuant to this subsection shall be transferred in the respective

job classification under which the employee is employed at the time of transfer and shall

not receive any diminution in compensation or respective amounts of accumulated leave

or sick leave, solely as a result of this transfer.


Article 49B - Human Relations Commission

(c) (2) The general counsel and any assistant general counsel are [in the
unclassified service of] SPECIAL APPOINTMENTS IN the State Personnel Management
System.

Article 70B - Office on Aging

(c) (1) Any individual 70 years old or older is eligible for appointment to any
[permanent classified service] NONTEMPORARY position in the State Personnel
Management System for which the individual qualifies, and the appointment is subject to
the provisions of the State Personnel and Pensions Article [that govern classified service
employees].                                                                                               

(2) Any individual who is first appointed to a [permanent classified service
position or unclassified service position] NONTEMPORARY POSITION GOVERNED BY
THE STATE PERSONNEL MANAGEMENT SYSTEM at the age of 70 or older shall not be
eligible for membership in the pension systems of the State.

Article 78 - Public Service Commission Law           

17.

(a)     Except as provided in subsection (b) of this section or otherwise by law, all
personnel of the Commission shall be subject to the provisions of the State Personnel and
Pensions Article [that govern classified service employees].

(b)     The following are in the [unclassified service of] EXECUTIVE SERVICE,
MANAGEMENT SERVICE, OR ARE SPECIAL APPOINTMENTS IN the State Personnel
Management System:

(1)     Commissioners;

(2)     Executive Director;
