The Board, subject to the authority of the Secretary as set forth in Article 41 of the
Code, shall have the following powers and duties:

(1)     To establish and maintain an office and to appoint and prescribe the
duties of a claims examiner, a secretary, clerks, and any other employees and agents as
may be necessary. Except as otherwise provided by law, these employees are subject to
the provisions of the State Personnel and Pensions Article [that govern classified service
employees];

(b)     Except as otherwise provided by law, the provisions of the State Personnel and
Pensions Article that govern [classified] SKILLED SERVICE AND PROFESSIONAL
service employees do not apply to the WSSC.

Article 31B - Patuxent Institution

(c)     (1) Except as provided in paragraph (2) of this subsection or otherwise by
law, all staff of the Institution are in the [classified] SKILLED SERVICE OR
PROFESSIONAL service [of] , WITH THE EXCEPTION OF SPECIAL APPOINTMENTS, IN
the State Personnel Management System.

(2)    The director, the associate directors, all social workers, sociologists,
physicians, psychologists, and other persons in positions that are determined by the
Secretary to be professional shall be appointed by the director, with the approval of the
Secretary, and are in. the [ unclassified service of] EXECUTIVE SERVICE, MANAGEMENT
SERVICE, OR ARE SPECIAL APPOINTMENTS IN the State Personnel Management
System.
