construction costs shall not exceed $70.5
million, provided, that:
(1) All projects listed on Schedule A are
completed with no further request for
future funding from the Transportation
Trust Fund or any other State source; and
(2) All cost overrun responsibility beyond
$70.5 million shall be the responsibility of
Prince George's County and either JKCI or
JKCS as outlined in paragraphs (C) and
(B) Further provided that the State shall
have the responsibility to construct and
complete the $26.8 million in projects on
Schedule A for which the State has
construction management responsibility.
Funding of the $26.8 million for which the
State has construction management
responsibility may not be increased by
budget amendment or otherwise. However,
if the State projects on Schedule A cost less
than $26.8 million after all construction
costs and payments, right-of-way
settlements, or estimates and contract
disputes have been resolved and paid, then
up to $3.0 million may be transferred to
either the county or JKCI/JKCS for use on
projects which have higher costs than
estimated on Schedule A. No funds may be
transferred from the $26.8 million identified
on Schedule A under MDOT construction
management responsibility to projects
under county or JKCI/JKCS construction
management responsibility until after the
Maryland Department of Transportation
has reviewed and certified that the cost
overruns for the county and JKCI/JKCS
projects are justified, provided that the
State's total commitment of funds does not
exceed $70.5 million.
(C) The Secretary may provide a grant to
Prince George's County of up to $12.5
million for construction or improvements to
county roads that are not directly located on
the Wilson Farm property. The grant shall
