SUPPLEMENTAL BUDGET NO. 5 - FISCAL YEAR 1997

Mr. President, Mr. Speaker,

Ladies and Gentlemen of the General Assembly

Pursuant to the authority conferred on me by Article III, Section 52, Subsection (5)
of the Constitution of Maryland, and in accordance with the consent of the (State Senate)
- (House of Delegates), duly granted, I hereby submit a supplement to Senate Bill 160
and/or House Bill 160 in the form of an amendment to the original budget for the Fiscal
Year ending June 30, 1997.

Supplemental Budget No. 5 will affect previously estimated funds available for
budget operations as shown on the following summary statement.

Adjustments to Revenue:

General Funds:

Contingent upon the enactment of legislation
permitting the Governor to transfer up to
$7,000,000 from the State Used Tire
Cleanup and Recycling Fund created under
§ 9-273 of the Environment Article to the
State General Fund.

Contingent upon the enactment of legislation
permitting the Governor to transfer
$13,600,000 from the fiscal year 1996
appropriation to the Dedicated Purpose
Account of the State Reserve Fund to the
General Fund; provided, however, that the
amount of $13,600,000 will be repaid to the
Dedicated Purpose Account during fiscal
years 1998 and 1999.
